On December 6th, 2019, James L. Day was a panelist at the ABI Winter Leadership Conference in Rancho Palos Verdes, California. Jim presented on a variety of topics relating to commercial cannabis and insolvency, including his work in representing the debtors in Garvin v. Cook Investments NW, 922 F.3d 1030 (9th Cir. 2019). Bush Kornfeld represented the Cook Investments debtors in confirming a Chapter 11 plan over the objection of the United States Trustee. The United States Trustee appealed plan confirmation to the 9th Circuit, where the appellate court affirmed plan confirmation. The 9th Circuit’s opinion establishes the availability of Chapter 11 relief to certain debtors in the cannabis industry.
